- The Scope of these Terms
These terms relate to JacksAdvice.com, it’s associated services and affiliates. These terms set out the Businesses agreement with freelance contributors to its publications and content through this website (https://www.jacksadvice.com) and all other associated media channels operated and registered by JacksAdvice.com. “Site” means https://www.jacksadvice.com and any associated websites, social media or channels under the JacksAdvice brand, which is owned and operated by JacksAdvice.com
“Business” means the Site, JacksAdvice.com and any and all associated services used to promote any brand awareness or Material on behalf of all associated services
“Material” means any copyright works as set out in the copyright legislation and covers Material that is intended for publication and use by JacksAdvice.com
All content provided on this Site and it’s associated services is for informational purposes only. The owner of this Site makes no representations as to the accuracy or completeness of any information on this site or found by following any link on this site. The owner will not be liable for any errors or omissions in this information nor for the availability of this information. The owner will not be liable for any losses, injuries, or damages from the display or use of this information.
These terms and conditions of use are subject to change at anytime and without warning or notice. It is your responsibility to check them every time you submit any Material for publication, access any of the associated services of the Businesses Site and Social Media, or make any comments through the services provided by JacksAdvice.com. By submitting Material for publication, or by agreeing to prepare Material for publication or by using the Site you agree to be legally bound by these Terms which will take effect immediately. If you do not agree to be legally bound by all of the following terms please do not access or contribute any Material to the Site or offer any of your Material for consideration of publication under the JacksAdvice brand. There shall be no variation to any of these terms, except with the express written permission and consent of the Editor In Chief. If any Contributor is not happy with these terms, then they should not offer JacksAdvice.com any Material whatsoever.
- Material Supplied by Contributors, Bloggers and Freelancers.
“Contributors” means any entity that contributes content to JacksAdvice and it’s associated services.
“Bloggers” means an external contributor, whether a person, company or other kind of body whose Material appears on the designated Categories and Sections of the Site as determined by the business.
“Freelancers” means any contributor whose Material appears on the designated Categories and Sections of the website as determined by JacksAdvice.
2.1 Rights of the Material
JacksAdvice and JacksAdvice.com want to be fair and clear in relation to the rights in the Material supplied by Bloggers, Contributors and/or Freelancers to the Site and all associated services and publications. JacksAdvice.com work hard to ensure that all content supplied reaches a broad and growing audience through the use of it’s Site and/or associated Services including but not limited to Social Media channels in order to publicly promote authors of all content on JacksAdvice. Because of this, all Material supplied to JacksAdvice.com shall be deemed non-exclusive and you have the right to re-use any Material that you submit to JacksAdvice.com with third parties. However, JacksAdvice.com require the exclusive right of first publication in any Material that you submit and there must be a minimum of a 6 week break between JacksAdvice publishing the material and any other digital publishers publishing the same material. There may be exceptions to this rule, but those exceptions must be in the form of a written consent from the Editor-In-Chief. Exclusions to this rule are companies that provide Press Releases to general media outlets and other companies or entities that provide news related items for use by JacksAdvice.com. You have 1 day for any existing content that has already been published on the Site, to appeal to the Editor In Chief and/or Owner of JacksAdvice.com in writing should you wish for your Material to be removed from the Site. Any request submitted for material to be removed from the Site after the 3 day period shall be null and void. Any material that is submitted or published from the initial date of publication of these Terms and Conditions shall be deemed to be subject to all Terms and Conditions contained herein with the exception of requesting removal of any material within the 1 day period, which only applies to existing content submitted and/or published before the initial publication of these Terms & Conditions on 27th January 2017.
Unless otherwise agreed, JacksAdvice.com:
(a) Becomes the property owner of all submitted and published Material and as such you are not allowed to delete, remove, alter or redirect material that has been submitted or published unless express permission has been granted in writing by the Editor-In-Chief of JacksAdvice and/or owner of JacksAdvice.com.
(b) Has the following rights which shall be deemed to be accepted on a Worldwide basis for any associated Material you submit:
(i) The right to distribute, licence, republish, syndicate, retransmit the Material in all present and future formats and media including but not limited to electronic, telephony, mobile, tablet, print and any other software or means that allows the distribution of Material.
(ii) The rights to the Title, Pseudonym and Format used in respect of your Material and to alter or change any content contained within your material including but not limited to the Title, Pseudonym, Images, Format and Links on the Site and all associated Services.
(iii) The right to store your Material in any database of it’s choosing and/or archive it in any future or present format or media.
(iv) The right to translate, cut, amend or alter your Material as JacksAdvice.com sees fit.
(c) You agree that JacksAdvice.com can use an image of you that you submit or consent to, along with your biography and Material for the purposes of information, promotion, publicity and any other activity that relate to the exercise of it’s rights under these Terms.
- Warranties, Liability and Indemnities
By using the Site and Services provided by and associated to JacksAdvice.com you accept that the Material you submit and/or publish is:
(a) to the best of your knowledge in no way defamatory of any entity or person
(b) is your own original work and Material and that neither it or any use will infringe any person’s rights including but not limited to performance, property, privacy, data protection and/or any other right
(c) is not likely to render you or JacksAdvice.com in breach of any criminal law or regulation whether during the course of your activities on behalf of JacksAdvice.com or otherwise.
(d) You completely agree to indemnify JacksAdvice, JacksAdvice.com and their legal owner(s) against any and all claims, costs, liabilities incurred, losses, loss of past, present and projected future revenues, profits, client loss, physical damage, opportunity, injury to reputation, losses suffered by third parties, loss of goodwill, and any indirect consequential and/or exemplary damages.
The business wishes to encourage a broad exchange of news and information sharing through the community that will lead to and grow the generation of stimulating, intelligent and informative debate.
- Acceptable Use Policy
JacksAdvice expects that all of its user be respectful to other people. If you notice any violation of this Acceptable Use Policy or other behaviour that you deem to be unacceptable by any user, you should report it immediately to the Site through our contact form located here
You are solely responsible for all Content and Information that you post on the Site or transmit by either physical or electronic means to another user(s). You agree that you will not hold JacksAdvice responsible for any or liable for any Content from other users that you interact with or access on the Site.
Examples of Prohibited Content include but are not limited to the following:
3.1 any content that is considered abusive, profane, offensive, obscene or defamatory;
3.2 is inaccurate, misleading or false in any way;
3.3 is illegal or aids in the promotion of illegal activities;
3.4 violates and/or infringes on another individual and/or party’s intellectual property rights (which include but are not limited to: photos, videos, music, audio recordings, or any other materials for which you do not have express written permission from the original owner/author or authority to post on the Site;
3.5 contains anything that can be deemed as harmful to the Site, including but not limited to computer code, software viruses, programs or files that designed to interrupt with the normal operability of the Site, limit it any way or aid in the destruction or change of information or equipment;
3.4 violates and/or infringes on another individual and/or party’s intellectual property rights (which include but are not limited to: photos, videos, music, audio recordings, or any other materials for which you do not have express written permission from the original owner/author or authority to post on the Site);
3.5 contains anything that can be deemed as harmful to the Site, including but not limited to computer code, software viruses, programs or files that designed to interrupt with the normal operability of the Site, limit it any way or aid in the destruction or change of information or equipment;
3.6. JacksAdvice reserves the right to alter, edit, modify, remove or shut down all or part of the JacksAdvice Website or its contents without further notice.
- Editorial Standards For JacksAdvice
The reputation of JacksAdvice.com both in Ireland and around the world is based on the editorial independence, high journalistic standards and integrity of the Site and/or associated services publications. Any person or entity that supplies Material and/or Content to any publications or contributes to the Site in any way must ensure that their conduct and Material are ethical, proper and legal. It is the responsibility of all bloggers, contributors and freelancers to ensure that they have kept themselves updated on all policies, code of practice and regulations that are applicable with the Press Ombudsman of Ireland (http://www.pressombudsman.ie). You agree that you will cooperate fully should any need arise with JacksAdvice.com in relation to any complaint that is submitted to the Site and it’s associated services. This applies also to complaints that may be received for any material you submit or publish through the Site and it’s associated services.
- Code Of Conduct
This code applies to all members and contributors to JacksAdvice.com and it’s associated services.
5.1 The highest standards of behaviour are expected when providing Material to JacksAdvice or representing JacksAdvice.com in any capacity both internally and externally.
5.2 You are forbidden from discussing any Material, Strategy, Decisions, Ideas submitted or put into action by either you or any other party associated with or affiliated with JacksAdvice.com with a third party unless express written permission has been granted by the Editor-In-Chief and/or Owner of JacksAdvice.com.
5.3 If any possibility or actual conflict of interest arises you should raise it immediately with the Editor-In-Chief or the person that you normally deal with in relation to your contribution to JacksAdvice who will if appropriate refer it to the relevant person to deal with, within JacksAdvice.com.
5.4 A bribe is defined as promising or giving a financial advantage or other advantage that is intended for another person or entity to perform improperly with one or more of their functions whilst in a capacity of trust and/or responsibility, or as a reward for improper performance. As such you are forbidden from participating in any act that would be deemed as Bribery when acting for and/or on behalf of JacksAdvice.com. If you are unsure whether or not something can be construed as a Bribe you should consult either a legal professional or the person you normally deal with in JacksAdvice.com or the Editor-In-Chief to discuss the matter in confidence.
5.5 As a non-employee your arrangements with JacksAdvice.com may leave you free to accept other work and/or activities where a possible conflict of interests may arise. You are responsible for ensuring that your work and/or activities whether personal or work-related do not threaten, degrade or in any way disgrace the reputation, brand and/or interests of JacksAdvice.com.
5.6 You are forbidden from accepting gifts or hospitality that will affect Editorial judgement, a business decision or could be construed as Bribery as set out in the terms and conditions. While JacksAdvice.com does accept products and services in order to review them as informative articles to the general public and visitors of the Site and associated services it is essential that all reviews are conducted in a manner that shall not be deemed as bias.
5.7 All manner of business relationships are to be advised to the Editor-In-Chief and/or Owner of JacksAdvice.com where it impacts the normal operation of the Site and it’s associated services. You are forbidden from agreeing on but not limited to any deal, contract, terms, negotiations with any outside party to JacksAdvice.com without the express written permission of the Editor-In-Chief and/or Owner of JacksAdvice.com and all manner of business conducted with third parties shall be done so in a lawful, ethical and fair way.
5.8 Failure to comply with any part of the Code Of Conduct, the Terms and Conditions and the Terms and Conditions for Contributors, Bloggers & Freelancers may lead to that person and/or entity having their relationship terminated with JacksAdvice and/ JacksAdvice.com without notice where all work, material and content either submitted or published will remain the sole property of JacksAdvice.com as set out in section 2 of these Terms and Conditions. Any other action including legal action may also be taken against the person and/or entity as JacksAdvice.com decides.
